1. About these terms
These terms govern your use of carshop.claybroussard.com and any purchase you make from Park Avenue Motors, a motor vehicle dealer owned by Michael Johnson, located at 753 Park Avenue, Columbus, Ohio 43223, USA, Ohio dealer licence OH-UD-2009-7534. By using this website you agree to them. If you do not agree, please do not use the site.
2. Website content
We take care to describe vehicles accurately, including mileage, options and known faults, and photographs show the actual vehicle for sale. Even so, listings may contain errors, and vehicles may be sold before a page is updated. Nothing on this site is a binding offer to sell; a contract is formed only when a written sales agreement is signed by both parties.
3. Pricing
All prices are in US dollars and exclude Ohio sales tax, title and registration fees, and the $250 documentation fee, which are itemised on your quotation. Advertised prices may change without notice. Where a price is obviously incorrect we will tell you before taking payment and you may cancel without penalty.
4. Orders, deposits and payment
A $500 holding deposit reserves a vehicle for 72 hours and is fully refundable. Accepted payment methods are cash, cashier's check, ACH, wire transfer, and debit or credit cards up to $5,000. We will never ask you to pay by gift card, cryptocurrency or transfer to a personal account — if you receive such a request, it is not from us; call us on +1 917-559-8087.
5. Delivery and risk
Delivery arrangements, costs and timings are set out in our Delivery Policy. Title and risk pass to you on delivery or collection. Estimated dates are estimates, not guarantees.
6. Returns and refunds
Our Refund & Return Policy forms part of these terms and explains the 7-day / 400-mile return window, deductions and refund timescales.
7. Warranties
Each vehicle is sold with a 3-month / 3,000-mile limited powertrain warranty unless the sales agreement states the vehicle is sold "as is", which is disclosed prominently in the listing and on the federal Buyers Guide displayed in the window. Extended service contracts are provided by third-party administrators under their own terms. Except as expressly stated and to the extent permitted by law, implied warranties of merchantability and fitness for a particular purpose are limited to the duration of the written warranty.
8. Financing
We are not a lender. We introduce customers to third-party lenders and may receive a commission for doing so, which is disclosed on request. Credit is subject to status and the lender's terms.
9. Acceptable use
You may not use this website unlawfully, attempt to gain unauthorised access to it, scrape it in bulk, introduce malicious code, or copy our photographs and text for commercial use without written permission.
10. Intellectual property
All content on this site — text, photography, the Park Avenue Motors name and logo — is owned by Park Avenue Motors or used with permission, and is protected by United States copyright and trademark law.
11. Limitation of liability
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability arising out of any purchase is limited to the price you paid for the vehicle, and we are not liable for indirect or consequential losses such as loss of earnings or loss of use.
12. Governing law and disputes
These terms are governed by the laws of the State of Ohio, and the courts of Franklin County, Ohio have exclusive jurisdiction. Before starting a claim, please contact us — most disputes are resolved by a phone call with the owner.
13. Changes
We may update these terms. The version in force is the one published on this page at the time you place an order.
